Appellate Div of NYS Sup Ct has granted preliminary injunction requiring removal of parts of WCBS-TV newscast from promotion film for Rapperswill Corp; decision affects only film's distribution in NYS; ct says case involves issue of public figure's right of privacy against constitutionally protected 1st Amendment rights; action against Rapperswill was taken by WCBS reporters Patricia C Reilly, Rolland G Smith and David Marash; they are asking for $3-million in punitive damages and $1.5-million in compensatory damages; Rapperswill used portions on newscast by Smith and Marash in its film without receiving permission from them; unanimous decision by Justices Arthur Markewich, Francis T Murphy Jr, Myles Land and Emilio Nunez, overturned Oct decision by Sup Ct Justice Thomas J Hughes, who held there was no showing of irreparable injury (S)
