NYS Justice A G Fraiman on Feb 23 refuses to quash subpoena directing NY Magazine to produce unpublished portions of controversial article written by former NYC Deputy Police Comr R Daley and entitled The Man Who Shot Rap Brown; publication's atty E D Hamilton contends subpoena will violate magazine's rights under First Amendment and under section of NYS Civil Rights Law that allows newsmen to refuse to disclose their sources of information; charges that if subpoena is upheld, Brown and his attys might obtain information they need in Fed ct suit against magazine; Fraiman explains that purpose of amendment to State Civil Rights Law is 'to prevent news sources from drying up,' adding that this is not at issue in Brown case because there is no secret about article sources; concedes that upholding of subpoena might give defense advantage but notes that Brown is charged with murder and faces possible sentence of life imprisonment, which makes matter of 'overriding' importance; says that Daley article as published was a 'substantially' altered version of original manuscript; holds that defense attys are entitled to examine article as it was written to see whether it conflicts with testimony of Ptl Manetta, who was principal source for article; Kunstler charges Daley article was 'deliberately fabricated' to prejudice prospective jurors; objects strongly to drawing accompanying article that shows Brown firing handgun at Manetta, who shot and captured Brown; prosecutor J T Litman has formally acknowledged that ballistic tests show that weapon in question was not fired
